27 April 2022 YA Atan Mustaffa appointed as Judge of the High Court of Malaya.

The Partners and staff of Messrs Ainul Azam & Co would like to extend our heartiest congratulations to our former Partner and Head of Litigation Department, YA Atan Mustaffa Yussof Ahmad on his appointment as Judge of the High Court of Malaya.

YA Atan Mustaffa joined Messrs Ainul Azam & Co in 2003 and was later sworn in as the Judicial Commissioner of the High Court of Malaya on 28th November 2019.

We wish YA Atan Mustaffa all the best and a successful career on the bench.

November 2019 Atan Mustaffa

We are proud to announce that the firm’s Partner and Head of Litigation, Atan Mustaffa Yussof Ahmad was sworn in as a Judicial Commissioner on 28th November 2019.

Atan graduated from the University of Bristol in the UK and received his Certificate in Legal Practice in 1994. After being called to Bar in 1995 he practised in the area of commercial and civil litigation with Messr Nordin Torji & Yussof Ahmad before serving in several in-house legal and management positions between 1998 and 2003. He also attended the University of Exeter during this period and received his MBA in 2000.

In 2003 Atan joined Messrs Ainul Azam & Co as a Partner to head the litigation department of the newly established firm. During this period, the firm expanded its client base and developed new areas of practice, namely in Employment and Industrial Relations Law.

As a member of the Bar, he actively contributed in various Bar activities, serving as a member of the KL Bar Committee between 2017 to 2019 and the Bar Council’s Professional Standards and Development Committee from 2017. He was also a trainer for the Advocacy Training Course.

We extend our heartiest congratulations to Atan Mustaffa and his family, wishing him success in his new career.

January 2012 ENFORCEMENT OF COMPETITION ACT 2010

The Malaysian Competition Act 2010 ("the Competition Act") comes into force on 1 January 2012 prohibits anti-competitive activities, such as horizontal and vertical anti-competitive agreements and abuses of dominance.

Generally, price-fixing agreements, marking sharing agreements and bid-rigging agreements and other collusive 'cartel’ (i.e. pakat in Bahasa Malaysia) agreements are considered to be anti-competitive.

The regulator of the Competition Act, the Malaysia Competition Committee ("MyCC") has extensive enforcement powers of investigation and enforcement and to issue directions and make decisions.

The proposed guidelines on the application on the Competition Act have already been posted on the website of MyCC. These guidelines are not yet definitive as they are still subject to a public consultation process.

In anticipation of the enforcement of the Competition Act, we have since year 2011 developed and implemented a Competition Compliance Programme for our corporate clients to ensure that the position of our clients is protected as regards to the coming into force of the Competition Act.
